Bipartisan Support for IVF Insurance Mandates: Key Findings and Legislative Actions

Introduction

Recent research presented at the ASRM Scientific Congress & Expo indicates significant bipartisan support for insurance mandates covering in vitro fertilization (IVF). This comes after notable initiatives aimed at increasing access to fertility treatments across various states.

Survey Findings

A study conducted by Leah E. Chapman, PhD, MPH, and her team at Harvard T.H. Chan School of Public Health surveyed 1,000 American adults in November 2024. The primary aim was to assess lifetime infertility prevalence and the public’s stance on state-mandated IVF insurance coverage.

  • Lifetime infertility prevalence among the respondents was found to be 8.9% (95% CI, 7.2%-11%).
  • Support for state mandates was shown by:
    • Democrats: 75.9% (95% CI, 71.2%-80.1%)
    • Independents: 60% (95% CI, 51.2%-68.2%)
    • Republicans: 55.3% (95% CI, 50.1%-60.5%)

Current State of IVF Coverage

According to Chapman, IVF is often seen as an optional procedure by many insurers, leading to coverage limitations. Reasons for restricted insurance coverage include:

  • Perceptions that infertility is largely a choice rather than a medical condition.
  • Absence of federal mandates requiring insurance coverage for IVF, with only 15 states mandating any level of coverage.

This inconsistency has created a fragmented system that varies significantly by state.

Why Focus on State-Level Mandates?

Chapman explains that states have been pivotal in advancing IVF coverage mandates. Examining these state regulations reveals where progress is being made and highlights gaps that need addressing. State legislation is currently the primary vehicle for enhancing access and protection of IVF services.

Potential for federal progress exists, but typically, it follows state-level momentum. Instances of successful state mandates often inspire similar national actions, a trend seen in various health policy areas.

Challenges to Federal Mandates

Chapman remains cautious about the likelihood of a federal mandate for IVF coverage in the near future. Factors contributing to this uncertainty include:

  • Long-standing ideological divisions regarding reproductive rights.
  • Concerns over costs and moral objections related to embryo creation and preservation.

However, the evolving landscape of state mandates, coupled with heightened public awareness, may shift political discourse towards greater federal oversight.

Legislative Initiatives

Current efforts to expand IVF access primarily occur at the state level, with many legislative initiatives underway. Key proposed bills include:

  • Protect IVF Act of 2025 (S. 2035): Aims to secure a statutory right to receive and cover fertility treatments.
  • IVF for Military Families Act (S. 1231/H.R. 2557): Seeks to ensure fertility services, including IVF, are covered for service members and their families.
  • Veterans Infertility Treatment Act of 2025 (H.R. 220): Proposes coverage for infertility and fertility preservation services for Veterans through the Department of Veterans Affairs.

Conversely, legislative measures like personhood bills present risks by classifying embryos as legal persons, which could impede standard IVF practices.

The Role of Physicians in Advancing IVF Legislative Efforts

Health care providers play a critical role in advocating for IVF access. Chapman suggests several actions physicians can undertake to influence legislation positively:

  • Stay updated on legislative developments affecting IVF access.
  • Offer expert testimony to legislative bodies on the importance of comprehensive IVF coverage.
  • Collaborate with advocacy organizations to mobilize support for favorable policies.
  • Utilize professional platforms to draw attention to barriers hindering access.
  • Encourage hospitals and practices to implement supportive policies for patients navigating insurance.
  • Empower patients by facilitating their involvement in advocacy initiatives.

Healthcare providers can direct patients to various resources to ease the complexities tied to accessing IVF care. Such support systems can help navigate financial and procedural challenges, assisting individuals in their fertility journeys.
